Expungement Fee Waivers

Utah has some of the highest government expungement fees in the country. These fees contribute significantly to the cost of clearing your record. However, a new law is making it easier for more people to get these fees waived.  Under Utah law, individuals may qualify for a waiver of BCI and court filing fees based on the following:

  • Income Level
  • Receipt of Government Benefits

Individuals who qualify for a fee waiver due to income level or by receiving government assistance qualify for our Expungement with Government Fee Waiver service.

income level:

The current thresholds for obtaining a fee waiver are determined by income level and household size. Consult the table below. If your income level is below the amount listed for your household size, you will qualify for a waiver of your court filing fees and BCI certificate fees for expungement.

A chart displaying annual and hourly income thresholds for fee waivers. It shows income levels for household sizes from 1 to 8 and the additional income for each extra household member. The annual income starts at $38,730 for 1 person, increasing to $79,080 for 8, with an extra $8,070 per additional person. Hourly income starts at $18.62 and increases to $38.02, with $3.88 per extra member.

receiving government assistance:

If you are on any kind of government assistance such as VA benefits, SNAP, or disability, you may qualify for a waiver of court filing and BCI certificate fees.
